Consumer Health Data Privacy Policy

This Washington Consumer Health Data Privacy Policy (“Policy”) describes the practices of Tami Widmer Coaching, LLC (“Tami,” “Company” or “We”) for collecting and using Washington residents' consumer health data, as that term is defined in the Washington My Health My Data Act (RCW 19.373.005 to 19.373.900).

 

This Policy applies to Tami's website(s), coaching services (virtual or in-person), intake forms, assessments, communications, emails, text messages, and scheduling tools. This Policy does not apply to any sites, products, applications, platforms, or other services not directly linking to this Policy. 

Please read this Policy carefully to understand our policies and practices regarding your consumer health data and how we will treat it. If you do not agree with our policies and practices, you should not use the sites, products, applications, platforms, or other services linking to this Policy.

Consumer Health Data We May Collect About You
 

We collect and use different types of consumer health data from and about you, including: 

  • Information about any of the following:

    • individual health conditions, treatment, diseases, or diagnoses 

    • diagnostic testing, treatment, or medication; 

    • social, psychological, behavioral, or medical interventions 

    • health-related surgeries and procedures; 

    • use or purchase of prescribed medication; 

    • bodily functions, vital signs, symptoms, or measurements of physical or mental health status; 

    • self-reported health goals or lifestyle habits; 

    • personal growth or wellbeing discussed during coaching sessions; or 

    • mental or emotional health shared during coaching sessions 

  • Gender-affirming care information, which is personal information relating to seeking or obtaining past, present, or future gender-affirming care services, including:

    • location information that could reasonably indicate a consumer's attempt to acquire or receive gender-affirming care services; 

    • efforts to research or obtain gender-affirming care services; or 

    • any gender-affirming care information that is derived, extrapolated, or inferred, including from non-health information, such as proxy, derivative, inferred, emergent, or algorithmic data. 

  • Reproductive or sexual health information, which is personal information related to seeking or obtaining past, present, or future reproductive or sexual health services, including:

    • individual health conditions, status, diseases, or diagnoses; 

    • social, psychological, behavioral, and medical interventions; 

    • health-related surgeries or procedures, including abortions; 

    • use or purchase of medication, including abortion medications; 

    • bodily functions, vital signs, symptoms, or measurements of the information described in this subsection; 

    • diagnoses or diagnostic testing, treatment, or medication; or 

    • medical or nonmedical services related to and provided in conjunction with an abortion, such as associated diagnostics, counseling, supplies, and follow-up services. 

  • Data identifying a consumer seeking health care services. Health care services means any service provided to a person to assess, measure, improve, or learn about a person's mental or physical health, including but not limited to:

    • individual health conditions, status, diseases, or diagnoses; 

    • social, psychological, behavioral, and medical interventions; 

    • health-related surgeries or procedures; 

    • use or purchase of medication; 

    • bodily functions, vital signs, symptoms, or measurements of the information described in this subsection; 

    • diagnoses or diagnostic testing, treatment, or medication; 

    • reproductive health care services; or 

    • gender-affirming care services. [Precise location information that reasonably indicates a consumer's attempt to receive or acquire health services or supplies. 

  • Any inferences of the above categories derived, extrapolated, or inferred from non-health information.

We use these categories of consumer health data for the following purposes: 

  • Providing and personalizing coaching services. 

  • Scheduling and conducting coaching sessions. 

  • Communicating with you regarding your coaching relationship. 

  • Processing payments for services. 

  • Maintaining internal records for continuity of services. 

  • Complying with legal obligations, including tax and accounting requirements. 

  • Facilitating services and operations performance, security, and integrity, including undertaking activities to prevent, detect, and investigate security incidents. 

 

Consumer Health Data Sources 

We collect consumer health data from the following sources: 

● You, including when you: ● complete intake forms and assessments; 

● communicate with us via email, text message, or telephone; 

● participate in coaching sessions (virtual or in-person); and 

● book appointments through scheduling platforms. 

● Scheduling platforms when you book appointments. 

● Payment processors when you submit billing information. 

 

 

Consumer Health Data Disclosures 

We do not sell your consumer health data. 

We may disclose any of the consumer health data categories listed above to processors, service providers, and contractors that help us provide products and services to you. 

We may also disclose your consumer health data to processors, service providers, and contractors that help us provide products and services to you, including: 

● Secure scheduling platforms (for appointment booking) 

● Payment processors (for billing and payment processing) 

● Client management software providers (for maintaining coaching records) 

● Our accountant (for business tax compliance) 

 

Tami Widmer Coaching does not have any affiliates with whom consumer health data is shared. 

We instruct these processors, service providers, and contractors to only use consumer health data as permitted by our contracts with them and consistent with applicable law. All service providers who process consumer health data on our behalf do so pursuant to written agreements that set forth processing instructions and limit the actions the service provider may take with respect to your data. 

We may also disclose consumer health data as permitted by applicable law, including: 

● With your consent.

● To prevent, detect, protect from, or respond to security incidents, identity theft, fraud, harassment, or malicious or deceptive activities. 

● To a third party acquiring our assets if Company sells its business or otherwise is part of a merger, acquisition, bankruptcy, or other transaction involving a third party taking control of our assets or business. 

 

Data Retention 

We retain personal and consumer health data only as long as necessary to: 

● Provide coaching services 

● Meet legal or accounting obligations 

● Resolve disputes 

 

Upon request, eligible data will be securely deleted in accordance with the deletion rights described in this Policy. 

Data Security 

We implement reasonable administrative, technical, and physical safeguards to protect your information, including: 

● Secure platforms and encrypted tools 

● Limited access to client data restricted to those for whom access is necessary 

● Password-protected systems 

 

No system is 100% secure, but we take data protection seriously and maintain security practices appropriate to the volume and nature of consumer health data we collect. 

Children's Privacy 

Our services are intended for adults 18 years and older. We do not knowingly collect consumer health data from minors. 

Your Privacy Rights 

You have specific rights with respect to your consumer health data. You have the right to: 

● Request confirmation that we collect, share, or sell your consumer health data. 

● Request access to your consumer health data that we have collected or control, including: o a list of all third parties and affiliates that we have shared or sold your consumer health data to; and

o the email addresses or other online method to contact those third parties and affiliates. • Withdraw your consent for our collection and sharing of your consumer health data. • Request that we delete your consumer health data. 

 

 

We will respond to your request free of charge, up to two times per calendar year. If requests are manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee or decline to act on the request. 

We will not discriminate against you for exercising any of your rights under this Policy or the Washington My Health My Data Act. You will not be denied services, charged different prices, or provided a different level or quality of services for exercising your privacy rights. 

How to Exercise Your Rights 

To exercise any of your rights under Washington consumer health privacy law, please contact us at:

We will respond to your request within 45 days of receipt. If reasonably necessary due to the complexity or number of requests, the response period may be extended by an additional 45 days. We will notify you of any extension within the initial 45-day period and explain the reason for the delay. 

Appeal Process 

If we decline to take action on your request, you may appeal that decision by submitting a written appeal to tami@tamiwidmertherapy.com within 30 days of receiving our decision. We will respond to your appeal in writing within 45 days, explaining any action taken or the reasons for denying the appeal. If your appeal is denied, you may contact the Washington State Attorney General's Office at www.atg.wa.gov to submit a complaint. 

Changes to This Policy 

We may update this Policy periodically. We will inform you of material changes through email notification. The "Last Modified" date at the top of this Policy indicates when it was last revised.
